"Safe-Watcher Cloud" (hereinafter referred to as the "Application" or "Safe-Watcher"): Refers to the web/mobile application developed, maintained, and offered by Safe-Watcher LLC, including all its features, content, and underlying technologies.
"Client": Refers to an individual or entity that utilizes the Application for the purpose of obtaining legal services, information, or any other functionalities provided by the Application.
"Attorney": Refers to a duly licensed legal professional or law firm that offers legal services, advice, or representation through the Application.
"User": A collective term that refers to both Clients and Attorneys who access, use, or otherwise interact with the Application.
"Content": Pertains to all forms of data, information, graphics, text, audio, video, or any other form of communication or representation, whether uploaded, posted, transmitted, or otherwise made available by Users or by Safe-Watcher LLC within the Application.
"Service": Refers to the functionalities, tools, resources, and any other offerings provided by the Application, encompassing both the functionalities used by Clients in seeking legal services and those utilized by Attorneys in providing such services.
Compliance with Laws and Regulations: By accessing or using the Safe-Watcher Application (hereinafter referred to as the "Application"), each User agrees to comply with all local, state, national, and international laws, rules, and regulations applicable to their use of the Application and any Services therein.
Age Restriction: The Application is not intended for users under the age of 18 years. By accessing or using the Application, the User represents and warrants that they are 18 years of age or older. Any access or use of the Application by anyone under 18 is unauthorized, unlicensed, and in violation of these terms.
a. Unauthorized access to, use of, or tampering with the Application, its servers, or any associated systems or databases.
b. Introduction or distribution of malicious software, including but not limited to viruses, worms, and Trojan horses, to the Application or its Users.
c. Infringement or violation of the intellectual property rights, privacy rights, or any other rights of Safe-Watcher LLC or any third party, including through the unauthorized use, reproduction, or distribution of any Content obtained through the Application.
d. Any other activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Application or its Services.
Ownership: All intellectual property rights, including but not limited to copyrights, patents, trademarks, trade secrets, designs, and any other proprietary rights associated with the Safe-Watcher Application (hereinafter referred to as the "Application"), its content, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all related rights, are the exclusive property of Safe-Watcher LLC or its licensors. The provision of the Application does not transfer to Users any ownership or other rights in the Application or its content.
Prohibited Acts: No User shall modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble the Application or any portion of it, or cause others to do so. Users are strictly prohibited from using, reproducing, distributing, or creating derivative works from any Content or proprietary material belonging to Safe-Watcher LLC or its licensors without obtaining prior explicit written permission. Any unauthorized use, modification, or distribution of the Application's content may result in severe civil and criminal penalties.
Data Collection and Usage: The Safe-Watcher Application (hereinafter referred to as the "Application") collects, processes, and uses user data in accordance with its established policies and practices, as described in detail in the Application's Privacy Policy. By accessing or using the Application, Users consent to the collection and use of their information as outlined therein.
Data Storage and Protection: All user data collected by the Application is stored using industry-standard security measures to protect against unauthorized access, alteration, disclosure, or destruction. Safe-Watcher LLC is committed to ensuring the integrity and security of User information. However, no method of electronic storage or transmission is 100% secure. While we strive to use commercially acceptable means to protect user data, we cannot guarantee its absolute security.
Third-party Sharing: Safe-Watcher LLC may share User data with third-party service providers or partners as necessary for the functionality of the Application or for the purposes outlined in the Privacy Policy. Such third parties are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which it was disclosed to them.

Termination by Safe-Watcher LLC: Safe-Watcher LLC, at its sole discretion, reserves the right to suspend, restrict, or terminate any User's access to the Safe-Watcher Application (hereinafter referred to as the "Application") at any time, without notice, for conduct that Safe-Watcher LLC determines to be in violation of this Agreement, any applicable law, or detrimental to the interests of Safe-Watcher LLC, other Users, or third parties. Additionally, Safe-Watcher LLC may terminate any User's access for any other reason or no reason, subject to any other terms and conditions that may be applicable.
User Termination: Users may terminate their accounts or discontinue their use of the Application at any time. To terminate an account, Users should follow the account termination procedures set forth within the Application or contact [Customer Support/Designated Department] directly. Upon termination of an account, the User's right to use the Application will immediately cease, and Safe-Watcher LLC may remove or delete all information, including but not limited to any content posted by the User, associated with such account.
Governing Law: This Agreement and the relationship between Users and Safe-Watcher LLC, pertaining to the use of the Safe-Watcher Application (hereinafter referred to as the "Application"), shall be governed by and construed in accordance with the laws of [Jurisdiction/State/Country], without regard to its conflict of law provisions.
a. Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, shall first be attempted to be resolved amicably through mutual discussions.
b. In the event that a resolution is not reached, such disputes shall be resolved exclusively through binding arbitration in accordance with the rules of [Name of Arbitration Institution] then in effect. The arbitration shall be held in [City, State/Country], and the proceedings shall be conducted in the [Language]. The decision of the arbitrator(s) shall be final and binding upon both parties.
Right to Modify: Safe-Watcher LLC reserves the right, at its sole discretion, to modify or replace any part of this Agreement at any time.
Notification: Changes to this Agreement will be posted on the Application or sent to Users via [email/notification method]. It is the responsibility of the User to review the Agreement periodically for changes.
Effective Date: Modifications will become effective immediately upon being posted on the Application, or on the date otherwise communicated in any notice provided. Continued use of the Application after any changes to the Agreement signifies the User's agreement to such changes.
In the event that any provision of this Agreement is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the Agreement. Such determination shall not affect the validity and enforceability of any other remaining provisions.
Streaming and Storage: The Application, under the brand name "Safe-Watcher", offers functionalities to stream video content and save the said content to the cloud. Additionally, Safe-Watcher transcribes videos into text format and posts the resultant text to the cloud for storage or further processing.
Geo-location Services: Safe-Watcher provides users with geo-location services, which aim to identify and provide the geographical position of the user. This feature is dependent on third-party APIs for accurate data retrieval.
No Guarantees: While Safe-Watcher endeavors to provide continuous and error-free services, technical glitches, interruptions, or malfunctions outside of our control might result in unsuccessful video streams, incomplete text files, or inaccuracies in geo-location data.
Safe-Watcher cannot guarantee uninterrupted services or successful video or text file generation due to such technology outages or errors in transmission beyond our control.
The accuracy and availability of geo-location services may be affected by the availability and functionality of third-party APIs. As such, we cannot guarantee the precision, consistency, or uptime of our geo-location services.
Commitment to Resolution: In situations within our control, Safe-Watcher commits to taking prompt corrective measures to rectify any issues. If a feature does not perform as intended and cannot be rectified promptly, Safe-Watcher reserves the right to deprecate or temporarily disable such feature until it meets our standards and is ready for public use.
Limitation of Liability: The User understands and agrees that Safe-Watcher shall not be liable for any damages, losses, costs, or expenses arising from the failure of video streams, transcription inaccuracies, the unavailability of cloud storage, or inaccuracies in geo-location data, especially those arising from causes beyond our control. The User acknowledges that they use the said functionalities at their own risk and discretion.
